Terms of service

1. Who you are contracting with

ForgeLot Civil is owned and operated by Mathew Robert Cashen, a sole trader registered in Australia (ABN 36 520 470 935), located in New South Wales, Australia. When you use the Service you are entering into an agreement with Mathew Robert Cashen. By creating an account or continuing to use the Service you agree to these terms.

2. Definitions

"ForgeLot", "we", "us" or "our" refers to Mathew Robert Cashen, the operator of the ForgeLot service. "You" or "Customer" refers to the organisation or individual that has registered for an account. "Service" means the ForgeLot web application and related features. "Customer Data" means the alignment files, chainage, lot geometry, and other project data you upload to or create within the Service.

3. Account and eligibility

You must provide accurate registration information and keep it up to date. You are responsible for activity that occurs under your account and for maintaining the confidentiality of your credentials. You must be authorised to act on behalf of your organisation to accept these terms.

4. Orders, merchant of record and payment

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation and refund mechanics are governed by the Paddle Buyer Terms, which apply to your purchase in addition to these terms.

5. Subscriptions, trials and refunds

ForgeLot is offered on a subscription basis. Each workspace may start one 14 day free trial. A card is required to start the trial and the trial converts to a paid subscription unless you cancel before it ends. Fees are billed in advance on the cycle you select, and you can cancel future renewals at any time from the billing page. We offer a 30 day money back guarantee, set out in our refund policy, and refunds are handled by Paddle. We may change pricing for future billing periods with reasonable notice.

6. Acceptable use

You agree not to misuse the Service, including attempting to disrupt its operation, accessing data you are not authorised to access, reverse engineering the Service, or uploading content you do not have the right to upload.

7. Customer data ownership and licence

You own your Customer Data. By uploading it to ForgeLot, you grant us a limited licence to host, process, and display that data solely for the purpose of operating the Service for you and your organisation. We do not claim ownership of your alignments, lot registers, or any other project data.

8. Intellectual property

The Service, including its software, design, and branding, is owned by Mathew Robert Cashen and his licensors. These terms do not grant you any rights to our intellectual property beyond the right to use the Service as intended.

9. Third-party map data

ForgeLot displays satellite and mapping imagery supplied by third-party providers. That imagery is subject to the accuracy, availability, and licensing terms of those providers, and we do not guarantee its currency or precision.

10. Availability and support

We aim to keep the Service available and responsive, but we do not guarantee uninterrupted access. We provide support in line with your subscription plan and will give reasonable notice of planned maintenance where practical.

11. Disclaimer for engineering decisions

ForgeLot is a record-keeping and visualisation tool. It does not replace surveyed set-out, inspection and test plans (ITPs), or the professional judgement of qualified engineers and surveyors. Decisions about construction, compliance, and payment should always be verified against surveyed data and your organisation's own quality processes.

12. Limitation of liability

To the maximum extent permitted by law, ForgeLot is not liable for indirect, incidental, or consequential damages arising from use of the Service, and our total liability for any claim is limited to the fees paid by you for the Service in the twelve months preceding the claim.

13. Termination

You may cancel your subscription at any time. We may suspend or terminate access to the Service for breach of these terms or non-payment. On termination, we will provide a reasonable window to export your Customer Data before it is deleted.

14. Governing law

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that state.
